Fruitvale Man Charged with Aggravated Robbery

Terrell Texas, - A Fruitvale man is recovering after being shot while he allegedly broke into a truck late Monday night. On March 5, 2012 at approximately 9:20 pm., Kaufman County deputies responded to a robbery call in the 10000 block of FM 2728.

When deputies arrived the homeowner told the deputies he heard someone pull into his driveway but they never came to the door. As he went to check outside he found a suspect inside his pickup truck. He told the suspect to get out of his vehicle and to stay where he was, he was calling 911. Instead the suspect went back to his vehicle, removing something from under the hood, and then came back toward the homeowner. The homeowner shot into the ground towards the suspect once, and the suspect returned fire missing the homeowner. The homeowner then shot the suspect once. The suspect then fled the scene and his unoccupied vehicle was later located by deputies on Highway 80, near the Elmo Food Stop. The suspect was found some 50 yards away with a gunshot wound to his leg.

Arrested and charged with Aggravated Robbery, is Preston Mitchell Wilson, 50, of Fruitvale. Wilson was taken into custody and transported to a Dallas hospital where he was treated and released into the custody of deputies. He remains in the Kaufman County Law Enforcement Center with bond set at $150,000.00. Wilson is charged with a First Degree Felony, which may be punishable by a fine not to exceed $10,000, and confinement for a term from 5 to 99 years in prison.

Charges are not expected to be filed against the homeowner. Sheriff David Byrnes stated, “While we certainly don not encourage the public to take the law into their own hands, the victim in this case apparently thought his life was in danger.”
